This Privacy Policy and Terms of Service (collectively, these "Terms") govern your access to and use of WriteUp AI, including our website, platform, scheduling pages, booking forms, report generation services, and related interfaces (collectively, the "Services") provided by Walker Ventures LLC d/b/a WriteUp AI ("WriteUp AI," "we," "us," or "our").

By accessing or using any part of our Services — including clicking "Continue," "See Available Times," "Generate Report," or similar — you acknowledge that you have read, understood, and agree to be bound by these Terms. If you are acting on behalf of an organization, you represent and warrant that you have authority to accept these Terms on its behalf.

We are committed to protecting the privacy and security of your personal information. We believe in transparency and minimal data collection — we only collect what is necessary to provide and improve our Services.

When you use our Services, you may voluntarily provide information including: your name, email address, and phone number; your company name, title, or role; details about your portfolio such as the number of properties managed and reporting frequency; financial documents you upload for report generation (such as T-12 operating statements, rent rolls, and budgets); free-form notes, questions, or preferences you submit; and payment information processed by our payment provider.

Information Collected Automatically

When you access our Services, we may automatically collect technical data including: your IP address, browser type, and operating system; device identifiers and screen resolution; pages visited, features used, and general usage patterns; and referral source and session duration. This information helps us maintain, secure, and improve our Services.

How We Use Your Information

We use the information we collect to: provide, operate, and maintain our Services including report generation, scheduling, and account management; send transactional communications related to your account, bookings, and reports; personalize and improve your experience with our platform; respond to your inquiries, comments, and support requests; monitor and analyze usage trends to improve our Services; detect, prevent, and address technical issues, fraud, or security concerns; and comply with applicable laws, regulations, and legal processes.

Data Sharing & Third-Party Services

We share your information only with trusted third-party service providers who assist us in operating our Services, and only to the extent necessary for them to perform their functions. These providers include scheduling and calendar management services, video conferencing providers for demo calls, payment processing providers, and infrastructure and cloud service providers. Each provider is contractually obligated to protect your data and use it only for the purposes we specify.

We may also disclose your information if required to do so by law, regulation, legal process, or governmental request; if we believe disclosure is necessary to protect our rights, your safety, or the safety of others; or in connection with a merger, acquisition, or sale of assets, in which case you will be notified.

Data Retention

We retain your personal information only for as long as reasonably necessary to fulfill the purposes described in this policy, maintain your account, comply with our legal obligations, resolve disputes, and enforce our agreements. Financial documents you upload for report generation are retained for the duration of your account. You may request deletion of your data at any time by contacting us.

When data is no longer needed, we will securely delete or anonymize it in accordance with industry best practices.

Security

We take the security of your data seriously. We implement industry-standard technical and organizational measures to protect your information, including encryption in transit (TLS/SSL) and at rest, row-level access controls on our database ensuring data isolation between accounts, role-based access controls limiting internal access to authorized personnel, regular security reviews and monitoring, and secure authentication and session management.

We will not send marketing text messages. You can opt out at any time by replying STOP. Standard message and data rates may apply.

After interacting with our Services, you may receive transactional emails related to your account, bookings, and reports. These include booking confirmations, appointment reminders, report delivery notifications, and account-related updates. These are service communications directly related to functionality you have requested and are not marketing messages.

We use cookies and similar technologies to maintain your session, remember your preferences, and understand how our Services are used. We use essential cookies required for the Services to function (such as authentication and session management) and analytics cookies to understand usage patterns and improve our platform. You retain ownership of any data, documents, and content you upload to our platform. By uploading content, you grant us a limited, non-exclusive license to process that content solely for the purpose of providing our Services to you.

Disclaimers

The Services are provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. WriteUp AI does not warrant that the Services will be uninterrupted, error-free, or completely secure.

Reports generated by our platform are based on data you provide. WriteUp AI does not guarantee the accuracy of generated reports and is not responsible for investment decisions made based on report content. You are responsible for reviewing and verifying all generated content before distribution.

Limitation of Liability

To the maximum extent permitted by applicable law, in no event will WriteUp AI, Walker Ventures LLC, or their respective officers, directors, employees, agents, or affiliates be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages — including but not limited to loss of profits, data, goodwill, business opportunities, or other intangible losses — arising out of or in connection with your use of or inability to use the Services, regardless of the theory of liability.

Our total aggregate liability for all claims arising out of or related to these Terms or the Services will not exceed the greater of (a) the amount you paid to us in the twelve (12) months preceding the claim, or (b) one hundred United States dollars (US $100).

Indemnification

You agree to indemnify, defend, and hold harmless Walker Ventures LLC, its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: your use of the Services; your violation of these Terms; your violation of any rights of a third party; or any content you upload, submit, or transmit through the Services.

Governing Law & Dispute Resolution

These Terms will be governed by and construed in accordance with the laws of the State of Texas, United States of America, without regard to its conflict of laws principles. Any dispute, claim, or controversy arising out of or relating to these Terms or the Services shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, the dispute shall be resolved exclusively in the state or federal courts located in Harris County, Texas, and you consent to the personal jurisdiction of such courts.

Changes to These Terms

We reserve the right to update or modify these Terms at any time. When we make material changes, we will update the revision date at the top of this page and, where appropriate, notify you via email or through the Services. Your continued use of the Services after the effective date of any changes constitutes your acceptance of the updated Terms.
